Sir/Madam,

I am directed to refer to this Division’s letter fo even number dated 3.2.2012 on the above subject and to say that certain clarifications were sought from DoPT on issues raised by some of the circles in the matter. DoPT vide their O.M. No. 36028/4/2012-Estt(Res) dated 11.9.2012 have clarifed that the provisions contained in order of the Hon’ble High Court of Andhra Pradesh. It is also intimated by DoPT that an SLP has been field against the decision of Hon’ble High Court of Andhra Pradesh in Supreme Court by the Ministry of Human Resources Development. However, the Hon’ble Supreme Court has not granted any stay order against the judgment of High Court of Andhra Pradesh.
