Updates of today’s/ Final hearing-

Advocate C K Sasi (AOR), who was well briefed by us, argued the case for M V Mohanan Nair. Advocates, representing to other respondents also done commendable job. Actually it was a well organised team work. Amicus Curiae presented the case extremely well. He also submitted a written statement of his arguments to the court. As a result, the court realized the following:

  1. There are anomalies in MACP scheme as evident from Minutes of Meeting of Anomaly Committee.
  2. These anomalies are affecting Group B & C employees and no impact on Group A.
  3. These anomalies have life long impact.

Arguments have been completed and the case is now reserved for orders. We expect a judgment allowing MACP on promotional hierarchy.

      I have been working as technical officer in the scale of RS. 6500/- 10500/- pre revised last 20 years. No further promotional scope in cadre. What will be MACP.

    whether eligible for 3rd Promotion (MACP) wef 01-01-2006 (Total Service 36 years )

    Sub: Application regarding injustice in 2nd MACP Benefits for the employees who have
    completed 20 years of service in ITBP between 01/01/2006 to 17/02/2011.
    Sir,
    According to the recommendations of the 6th pay commission, under the MACP Scheme of central government the three upgradation of next higher ranks after completion of 10, 20, and 30 years of service have been accepted. The MACP of different cadre other than next higher promotion rank is irrelevant. The following points are given below in this regards

    1) I Reg No-880130757 Ex Head Constable/GD Sahab Singh joined ITBP as a Constable /GD on 27/01/1988 and after completing 12 years of service between 01.01.1986 to 17.02.2011 there is a provision of getting 1 st ACP Benefits after completing 12 years of service and 2nd MACP Benefits after completing 20 years of service in the next higher rank promotion but my department has given me different rank benefit other than 2nd MACP of next higher rank promotion.

    2) Instead of providing me 2nd MACP financial benefits for sub-inspector/GD in the pay band of PB-2 Rs 9300-34800 + G Pay 4200, they have provided me different cadre financial benefits which is assistant sub inspector in the pay band of Rs 5200-20200 + G Pay 2800 which is different from my next promotion cadre which should have been sub inspector rank which is irrelevant according to MACP.

    3) Applicant was given financial benefit of 2nd MACP and at that time (before 17.02.2011) the next promotion cadre after Head constable /GD was subinspector/GD. There was not any rank of assistant sub-inspector/GD in the ITBP before 17.02.2011 and the post of assistant sub-inspector was created in ITBP on 17.02.2011(Home ministry order no-2-27012/3/2011-PF. 3 Government of India, Ministry of Home Affairs Dated 17th February 2011 or Directorate General order No1-16015/5/2012/(part-1)-18511-61 Dated 21.09.2012)(copy enclosed page no 8 to 10)

    4) According to different office orders of ITBP the grade pay of 2800 have been accepted for 2nd MACP applicant and other applicant (page no 11 to 20)
    Whereas according to Directorate General , sector headquarter and unit headquarter office orders those who have got promotion from constable to head constable and head constable to sub inspector between 01.01.2006 to 01.09.2008 was given 2nd MACP grade pay 4200/-.

    5) The only difference between ACP and MACP policy is that, in the year 1999 in ACP policy after completing 12 and 24 years of service, two ACP has been provided whereas after 6th pay commission, MACP policy provides three MACP after the completion of 10,20 and 30 years of service. According to para-2 of MACP policy, there is no any change in this.

    6) According to the circular of home ministry police 4 order no-MHA UO NO.- 27014/02/2010/PF-4 Dated 27.08.2012(Grant of 1st ACP to head constable and 2 nd ACP to constable to post sub-inspector in accordance with original scheme of ACP 1999) the next higher rank promotion has been given after head constable is sub inspector [copy enclosed(page no21 to 23)]
    7) According to case no 3744/2016 of supreme court of India the benefits of 2nd MACP is directed to be given from 01.01.2006 but applicants are being given MACP according to old office order Dated 01.09.2008[copy enclosed(page no24 to 35)]

    8) From the date of implementation of 6th pay commission o, the post of assistant sub-inspector was to be created but this post of assistant sub-inspector was created by home ministry or Department on 17.02.2011 even after not having the post of assistant sub-inspector in the force, the salary (financial benefits) of this post was given, which is not justified.

    9) Dual criteria for fixation of salary nomination in a department were adopted, which is injustice to the applicant, so it is requested that this dual criteria for salary nomination in the department should be eliminated. The applicant will have to go to the court’s shelter if he does not get justice, while in the above context, the court has made following comments in our favor

    *while disposing of the writ petition and directing the respondents to treat the mandamus issued vide order dated 09.10.2009 passed in WP(C) No.12258/2009 as the mandamus issued in the instant writ petition, we censure Sh. Pritam Lal, Under Secretary. (Pr-V), Government of India, Ministry of Home Affairs and direct that a copy of this decision would be placed in his service book and as and when his case is placed before a Department Promotion Committee, it is highlighted that this Court as censured Sh.Pritam Lal, Under Secretary*

    Therefore keeping in mind the prescribed facts as mentioned above , it is requested to you kindly direct the ITBP to please provide applicants 2nd MACP Grade pay 4200/-,

    विषय :- दिनाँक 01 जनवरी, 2006 से 17 फरवरी, 2011 के दौरान 20 वर्ष सेवा पूर्ण करने वाले कर्मीयों के साथ दोहरे मानदण्ड के चलते 2nd MACP लाभांश में हुए अन्याय के सन्दर्म में प्रार्थना पत्र।

    महोदय,
    6 वें वेतन आयोग की सिफारिशो के तहत केन्द्र सरकार द्वारा MACP स्कीम के तहत 10,20, व 30 वर्ष की सर्विस पूरी होने पर 03 उच्च पदों का अपग्रेशन कर वित्तीय लाभ दिये जाने का प्रावधान स्वीकृत किया गया है। *अगले पदोन्नति पद से पृथक कैड़र के पद का MACP अप्रांसगिक है(Punjab and Haryana High court -Chandigard का निर्णय cwp No.28431 of 2014 Date of Decision 31.08.2016 देखे,- छायाप्रति पृष्ठ संख्या 04 से 07 तक संल्गन है) लिंक –

    इस सम्बन्ध में बिन्दुवार ब्यौरा निम्नवत है* :-

    (01) यह है कि मैं दल संख्या 880130757 भूतपूर्व हैड़ कांस्टेबल जी.डी. साहब सिंह ने दिनाँक *27/01/1988* को भारत तिब्बत सीमा पुलिस बल में कांस्टेबल/जी.डी. नियुक्ती पाई तथा दिनाँक 01.01.1986 से 17.02.2011 के मध्य 12 वर्ष सेवा पूर्ण पर 1st ACP लाभांश व 20 वर्ष सेवा पूर्ण पर 2nd MACP के वित्तीय लाभांश अगले उच्चत्तर पदोन्नति पद से भिन्न रैंक के वित्तीय लामांश विभाग द्वारा प्रदान किये गये।

    (02) यह है कि 20 वर्ष की सेवा पूर्ण करने के उपरान्त 2nd MACP (एम.ए.सी.पी.) का वित्तीय लाभांश उप निरीक्षक/ जी.डी. के वेतनमान PB-2 Rs.9300-34800+G.Pay 4200 के स्थान पर पृथक कैड़र के सहायक उप निरीक्षक पद के वेतनमान PB-1 Rs.5200-20200+G.Pay 2800 का निर्धारण किया गया जो अगले पदोन्नति पद से पृथक कैड़र के पद से सम्बन्धित था जो अगले पैमाने पर MACP (एम.ए.सी.पी.) अनुदान के लिए प्रासंगिक नहीं है। अगला प्रचारक पोस्ट प्रासंगिक है।

    (03) यह है कि प्रार्थी को 2nd MACP (एम.ए.सी.पी.) योजना का वित्तीय लाभांश प्रदान किया गया तत्समय में जी.डी. कैड़र में हैड़ काँस्टेबल जी.डी. से पदोन्नति का अगला एवेन्यू उपनिरीक्षक/ जी.डी.(एग्जिक्यूटिव) था। प्रार्थीयों के संवर्ग में दिनाँक 17.02.2011 से पहले सहायक उप निरीक्षक/जी.डी. का पद बल में सृजित नहीं था सहायक उप निरीक्षक/जी.डी. का पद भा.ति.सी.पुलिस में दिनाँक 17.02.2011 से सृजित किया गया है (ग्रह मंन्त्रालय के आदेश संख्या – 2 – 27012/3/2011-PF . 3 GOVERNMENT OF INDIA MINISTRY OF HOME AFFAIRS DATE 17th February, 2011 व महानिर्देशालय के आदेश संख्या 1-16015/5/2012/स्थापना(भाग-1)-18511-61 दिनाँक 21.09.2012 की (छायाप्रति पृष्ठ संख्या 08 से 10 तक संल्गन है) लिंक –

    (04) यह है कि भारत तिब्बत सीमा पुलिस बल के विभिन्न आदेशों के तहत 2nd MACP प्रार्थी व अन्यों सभी का gard pay 2800/- स्वीकृत किया गया है आदेश की छाया प्रति संल्गन है। (पृष्ठ संख्या …….से ……तक)
    जबकि महानिर्देशालय,सेक्टर मुख्यालय, यूनिट मुख्यालय के विभिन्न आदेशों के तहत दिनाँक 01.01.2006 से 01.09.2008 के मध्य में Constable to Head Constable and Head Constable to Sub Inspector पदोन्नति पाने वालों को 2nd MACP वेतनमान ग्रेड़ पे 4200/- वाला दिया गया।

    (05) यह है कि ए.सी.पी. एवं एम.ए.सी.पी. दो योजनाओं में केवल अन्तर यह है कि 1999 में ए.सी.पी. योजना में 12 और 24 वर्ष पूरे होने के बाद दो ए.सी.पी. उपलब्ध कराए गये है जबकि छठे वेतन आयोग उपरान्त एम.ए.सी.पी.योजना 10, 20 और 30 वर्ष की सेवा पूरी होने के बाद तीन एम.ए.सी.पी. प्रदान करती है। एम.ए.सी.पी. योजना के पैरा -2 का भी अवलोकन से पता चलता है कि इसमें कोई परिवर्तन नहीं है। यह संम्बधित पदोन्नति/ संगठन के पदानुक्रमः में अगली पदोन्नति पद से संल्गन ग्रेड़ पे के सन्दर्भ में है।
    (6) यह है कि ग्रह मंन्त्रालय पुलिस वित्त 4 के आदेश संख्या MHA UO NO.- 27014/02/2010/PF-4 Date 27.08.2012 के अनुसार भी (Grant of 1st ACP to Head Constable and 2nd ACP to Constable to post Sub Inspector in Accordance with original scheme of ACP 1999 के अनुसार भी अगले उच्चत्तर रैंक sub Inspector की की जाती रही है। (आदेश की प्रति संल्गन है पृष्ठ संख्या …… से …… तक)।

    (07) यह है कि Supreme Court of India Case No.3744/2016 के नये आदेशोंनुसार 2nd MACP का लाभांश दिनाँक 01.01.2006 से दिये जाने के आदेश जारी किये है। लेकिन प्रार्थीयों को अभी तक पुराने आदेश 01.09.2008 के अनुसार ही MACP दी जा रही है।(छायाप्रति पृष्ठ संख्या …. से ….तक संल्गन है)

    (08) यह है कि 6वें वेतन आयोग के लागू होने की तिथि से बल में सहायक उप निरीक्षक/ जी.डी. का पद सृजित करना था जिसे ग्रह मंन्त्रालय व विभाग की ने दिनाँक 17.02.2011 को सृजित किया गया। बल में सहायक उप निरीक्षक/ जी.डी. का पद नहीं होने के बाद भी इस पद के वेतनमान(वित्तीय लाभांश) दिये गये जो कि न्यायोचित नहीं है।
    (9) यह है कि एक विभाग में वेतनमान निर्धारण के दोहरे मानदण्ड (अलग – अलग पैमाने) अपनाये गये है जो कि प्रार्थी के साथ अन्याय है अतः महोदय से निवेदन यह है कि विभाग में वेतनमान के दोहरे मानदण्ड को खत्म किया जाये। न्याय न मिलने पर प्रार्थी को न्यायालय की शरण में जाना पडेगा जबकि उक्त सन्दर्म में न्यायालय ने निम्न टिप्पणी अपने फैसमें की है। *While disposing of the writ petition and directing the respondents to treat the mandamus issued vide order dated 9.10.2009 passed in WP(C) No.12258/2009 as the mandamus issued in the instant writ petition, we censure Sh.Pritam Lal, Under Secretary, (Pr-V), Government of India,Ministry of Home Affairs and direct that a copy of this decision would be placed in his service book and as and when his case is placed before a Departmental Promotion Committee, it be highlighted that this Court as censured Sh.Pritam Lal, Under Secretary*
